These Terms of Sale, Shipping, and Data Privacy Policy ("Terms") govern all purchases, orders, and the use of personal data made by customers located in the United States ("you" or "Customer") through the website infinitekparis.us and any related store, application, or sales channel operated by Infinitek Paris ("Infinitek Paris", "the Company", "we", "us"). By placing an order, creating an account, or using our US website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

Access to and use of this website, as well as the purchase of any product offered on it, is conditioned upon your acceptance of and compliance with these Terms. If you do not agree with any part of these Terms, you must not use this website or place orders.

We reserve the right to update or modify these Terms at any time without prior notice. The version published on the website at the time of your order will govern that transaction. Your continued use of the website following the posting of changes constitutes your acceptance of the revised Terms.

2. Products, Pricing, and Order Acceptance

All product descriptions, images, and prices are subject to change without notice. We make reasonable efforts to display product colors and details accurately, but we do not guarantee that your device's display will reflect the actual product.
Prices are listed in US Dollars (USD) and do not include applicable sales tax, which will be calculated and displayed at checkout in accordance with your state's tax laws.
We reserve the right to refuse or cancel any order at our sole discretion, including cases of suspected fraud, pricing errors, or out-of-stock items. If your order is canceled after payment, you will receive a full refund to your original payment method within 15 to 20 business days.
Our skincare and cosmetic products are formulated and manufactured for general dermocosmetic use. The statements made regarding our products have not been evaluated by the US Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease. Always review the ingredient list and perform a patch test if you have sensitive skin or known allergies, and discontinue use and consult a physician if irritation occurs.

3. Shipping Policy

3.1 Processing and Delivery Times

Orders are generally processed within 3 business days after confirmation. Estimated delivery times will be displayed at checkout and in the order confirmation email. These are only estimates and do not constitute guaranteed delivery dates, unless expedited shipping with a guaranteed delivery window is purchased.

3.2 FTC Mail, Internet, or Telephone Order Merchandise Rule Compliance

In accordance with the US Federal Trade Commission (FTC) Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435):

If we do not specify a shipping time at the time of purchase, we will ship your order within thirty (30) calendar days of receiving it, unless otherwise stated.
If we cannot ship within the promised time frame (or within 30 days if no time frame was promised), we will notify you of the delay, provide a revised estimated shipping date, and give you the option to either accept the delay or cancel your order for a full refund.
If you do not respond to a delay notice when required, or if we are unable to ship the order at all, we will cancel your order and issue a full refund within the time frames required by law.

3.3 International Shipping and Customs

Some or all products may be fulfilled and shipped from outside the United States (including from Colombia). International shipments may be subject to US customs inspection, import processing times, and, where applicable, tariffs, taxes, or import duties, which are the Customer's responsibility unless otherwise stated at checkout. We are not responsible for delays caused by customs authorities or carriers outside of our control.

3.4 Risk of Loss and Title

The risk of loss and title for products pass to you upon our delivery of the order to the carrier. We are not responsible for lost, stolen, or damaged products after the carrier confirms delivery to the address provided at checkout. If a package is marked as delivered but you have not received it, please contact us within 3 days so we can assist you in filing a claim with the carrier.

3.5 Shipping Errors

If you receive an incorrect or damaged item, please contact us at support@infinitekparis.com within 3 days of delivery, attaching photos of the item and packaging, so we can quickly arrange a replacement or refund.

4. Returns, Refunds, and Cancellations

Please refer to our separate Returns and Refunds Policy for complete details on eligibility, time frames, and the return process. For hygiene and safety reasons, opened, used, or damaged cosmetic and skincare products may not be eligible for return.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFINITEK PARIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF THE WEBSITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
